  1. Items are sold as is, and all sales are final unless the item doesn’t match the description. You can inquire about items before bidding. Descriptions are our opinion, and we try to be accurate but won’t be liable for errors. It’s your responsibility to examine items. If you’re unsure, don’t bid. Check diamond details in certifications, not pictures.
  2. The Gem Link and the consignor do not make any warranties or representations about the property’s value or attributes. They are not responsible for the accuracy of descriptions, authenticity, or appraisals. Appraisals are for convenience only and may not reflect actual values. No statement is a warranty, and differing appraisals won’t warrant returns or refunds.
  3. The Gem Link liability is limited to the purchase price paid by the buyer. They are not liable for indirect or consequential damages under any circumstances, including loss of profits.
  4. The highest bidder acknowledged by us wins. The Gem Link can resolve disputes and has the final say. If a mistake happens and an item is accidentally sold, We can cancel the sale. Bids can be made online, by phone, fax, or email, but certain methods are limited to qualified dealers. The Gem Link’s sale record is final.
  5. Once the hammer falls or an online auction ends, the bidder is responsible for their items. Mistaken bids can’t be cancelled. You’re responsible for your account and bids, even if someone else uses it. If an entity bids, the person doing it guarantees payment.
  6. A bidder’s bid is a binding offer. We may reduce a reserve price, and reserve prices are not disclosed. Bids are binding and final. The Gem Link has the ultimate say in the sale. If there’s an internet connection issue, We can cancel the auction.
  7. If the buyer doesn’t pay on time, The Gem Link can: (a) hold them liable for the full purchase price, (b) cancel the sale and keep payments, (c) resell the property, (d) resell without reserve, and the buyer covers any losses, (e) offset the price against The Gem Link’s debts to the buyer, (f) ban the buyer from future auctions, and (h) take other necessary actions.The Gem Link has a security interest in the buyer’s property. The buyer is responsible for all charges due to non-payment. If the buyer doesn’t pay, the consignor handles collection, and non-payment can be reported to credit agencies.
  8. The Gem Link can reject any bid, exclude any person or bid, and withdraw any lot at their discretion without explanation or liability, before, during, or after the auction.
  9. Upon winning the auction, the highest bidder takes ownership but must fulfil all conditions. They assume risk and responsibility, including insurance. Payment must be prompt; late fees apply. Non-compliance can lead to sale cancellation, resale costs, rejected future bids, interest charges, legal action, or other remedies. Unpaid amounts may be offset against the buyer’s other assets. In case of default, a 20% charge may apply, and non-payment may be reported to credit agencies.
  10. This auction allows the auctioneer, employees, sellers, or their agents to bid at their discretion, despite platform policies. Bidders are informed of this practice, which is permitted by law. There may be hidden reserve prices, and The Gem Link can bid to protect them without revealing the reserve amount. Bidders acknowledge these terms, and participation is optional.
  11. All items are subject to prior sale. If an item(s) are sold by the consignor prior to the start of the auction the auction company and auctioneer for The Gem Link will bid and sell off said lot acting as an agent to protect the sold lots for the consignor(s).
